Information on the processing of personal data

Information on the processing of personal data provided pursuant to and for the purposes of Italian Legislative Decree 196/2003

PURPOSE OF THIS DOCUMENT

The following information describes how the personal data of users of the websites www.andrì.com and www.andrì.it, which may be collected while browsing them, are processed. This information is provided pursuant to Article 13 of Italian Legislative Decree No. 196 of 20 June 2003 — Personal Data Protection Code — to those who interact with the web services accessible electronically from www.andrì.com and www.andrì.it. The information below also draws on the guidelines derived from Article 29 of Directive 95/46/EC and concerns in particular the collection of personal data on the Internet, with the aim of identifying the minimum measures to be implemented in relation to data subjects in order to ensure the fairness and lawfulness of such practices.

DATA CONTROLLER

Following consultation of the websites www.andrì.com and www.andrì.it, hereinafter referred to as the SITE, data relating to identified or identifiable persons may be processed. The “Data Controller” is Intersailing S.r.l. — Via G. Nicotera, 29 — Rome (RM) — Italy, hereinafter identified as the DATA CONTROLLER on behalf of Andrì.

SCOPE

This information is provided only for the SITE in question and not for other external websites that may be accessed through links on the SITE’s pages leading to different domains, for which the DATA CONTROLLER is not responsible.

PLACE OF DATA PROCESSING

Processing connected with the web services on the SITE (physically hosted on servers connected to the network) is carried out at the DATA CONTROLLER’s premises and is handled only by employees, collaborators or persons appointed to process the data, or by persons appointed to carry out occasional maintenance operations. No data resulting from browsing the SITE is communicated or disclosed to third parties whose activities are unrelated to the management, operation or control of the SITE itself. Personal data supplied by users who submit requests for information material are used solely for the purpose of providing the requested service or performance and are communicated to third parties where this is necessary for that purpose, except as provided in the section “Optional provision of data”.

TYPES OF DATA PROCESSED

Browsing data

The IT systems and software procedures used to operate the SITE acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected in order to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, make it possible to identify users. This category of data includes, by way of example, the IP addresses or domain names of the computers used by users connecting to the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the user’s operating system and IT environment. These data are used solely to obtain anonymous statistical information on use of the SITE and to check that it is operating correctly. The data may be made available by the DATA CONTROLLER for the purpose of establishing liability in the event of alleged computer crimes or other requests authorised by the judicial authorities. Data voluntarily provided by users of the site: the optional, explicit and voluntary sending of email messages to the addresses indicated on the SITE, or the completion of request forms or other guided procedures on the SITE itself, entails the subsequent acquisition of the sender’s address, which is necessary in order to reply to requests, as well as any other personal data entered. Specific summary notices will be displayed on the pages of the site prepared for particular services on request.

OPTIONAL PROVISION OF DATA

Apart from what is specified for browsing data, users are free to provide the personal data contained in request forms or otherwise indicated in contacts in order to request the sending of information material or other communications. Failure to provide such data may make it impossible to obtain what has been requested. For completeness, it should be remembered that, in certain cases (not part of the ordinary management of this site), the Authority may request information pursuant to Article 157 of Italian Legislative Decree No. 196/2003 for the purposes of monitoring the processing of personal data. In such cases, a response is mandatory and failure to respond may result in an administrative penalty.

USERNAME AND PASSWORD

If users are required to choose a “username” and/or “password” in order to access restricted sections of the SITE, it is their responsibility to keep such data confidential and to notify the DATA CONTROLLER immediately if they are used by unauthorised persons.

COOKIES

Cookies are short text files that are downloaded to the User’s device when visiting a website and allow the SITE to recognise the User’s device. They serve different purposes, such as enabling efficient navigation between pages, remembering favourite sites and, in general, improving the browsing experience. Depending on their function and purpose, cookies may be divided into technical cookies, profiling cookies and third-party cookies. METHODS OF PROCESSING

Personal data are processed with and without electronic or otherwise automated, IT or telematic tools for the time strictly necessary to achieve the purposes for which they were collected. Specific security measures are observed to prevent loss of data, unlawful or incorrect use and unauthorised access, in compliance with the obligations concerning minimum security measures. In order to provide a complete service, the SITE may contain links to other websites that are not managed by this DATA CONTROLLER, who cannot be held responsible for errors, content, cookies, publication of unlawful or immoral content, advertising, banners or files that do not comply with applicable legislation, or for compliance with privacy legislation by those websites.

RIGHTS OF DATA SUBJECTS

Persons to whom the personal data relate have the right at any time to obtain confirmation as to whether or not such data exist and to know their content and origin, verify their accuracy or request their integration, updating or rectification (Article 7 of Italian Legislative Decree No. 196/2003). Pursuant to the same article, they have the right to request the deletion, transformation into anonymous form or blocking of data processed in breach of the law, as well as to object, on legitimate grounds, to their processing. In any event, Users remain free at any time to withdraw any consent they have given by sending an informal communication to the DATA CONTROLLER using the contact details given at the beginning of this document.

CHANGES TO THIS PRIVACY POLICY

The DATA CONTROLLER reserves the right to update this Privacy Policy at any time in order to adapt it to changes in the law and to improve it, also taking into account suggestions submitted by customers, collaborators and users.

Cookies

WHAT IS A COOKIE?

Cookies are short text files that are downloaded to the User’s device when visiting a website. On each subsequent visit, cookies are sent back to the website that originated them (first-party cookies) or to another website that recognises them (third-party cookies). Cookies are useful because they allow a website to recognise the User’s device. They serve different purposes, such as enabling efficient navigation between pages, remembering favourite sites and, in general, improving the browsing experience. Depending on their function and purpose, cookies may be divided into technical cookies, profiling cookies and third-party cookies.

TECHNICAL COOKIES

Technical cookies are intended to enable functions without which it would not be possible to make full use of the SITE. These cookies enable procedures based on multiple steps (several successive pages, such as a contact request), and keep track of the user’s choices regarding the SITE content to be displayed and the functions to be enabled or disabled. A cookie of this type is also used to store the user’s decision regarding the use of cookies on our website. Essential cookies cannot be disabled using the SITE’s functions. Technical cookies also include those used to statistically analyse access to or visits to the site, also known as “analytics” cookies, which are used exclusively for statistical purposes and collect information in aggregate form without making it possible to identify individual users. Analytics cookies may also be third-party cookies (Google Analytics); for further information, please refer to the privacy policy of the relevant provider.

PROFILING COOKIES

Profiling cookies are intended to improve the SITE user experience by suggesting content related to the preferences expressed by the user while browsing, based on the content viewed and other behavioural parameters. Users may choose to disable individual SITE cookies using the relevant options in their browser. In this case, some SITE functions may not be available.

THIRD-PARTY COOKIES

The SITE uses certain external functions or contains external links in order to improve integration with commonly used third-party websites and the social features of the SITE itself (for example, Facebook and Google sharing buttons). These functions and links may result in the use of third-party cookies; please refer to the specific privacy policies published on the relevant websites.
